This is a really important observation. I would want to change the term white privilege to white supremacy in this particular instance. Primarily because white privilege really only came into existence after a large collective of people believed in white supremacy. To me it appears it is not always class based favoritism that survives to dismantle African American freedoms. But simply the pervasive idea that white and black people are a separate race from each other which because of the historical precedent almost always leads to these differences being interpreted in favor of the white race as superior. Of course people will subvert laws if they think a law is trying to legislate or coerce a person to see another person’s humanity. Perhaps it might be the mockery inherent to the idea of legislating humanity? I think we have to consider that the very laws themselves actually work toward the opposite. But not for the reasons some people posit from a selfish position. Deep down we know the arbitrariness of trying to legislate someone as a human. That could never be done in a court system with documents and pieces of paper and we are silly humans for thinking it can. I don’t know what the purpose of the laws were back then? If I was a white supremacist I would definitely think that it was within my power to legislate someone else’s humanity into existence. As if I held that power because they in fact are lower species that need my legitimacy to be seen as human beings. The laws are self defeating. What we need is a reformation of thinking. We need education rather than more laws. The only laws I would be interested in enforcing at this point would be laws to enforce people to sit through a week long anthropology class in all 50 states. Then I believe the cancerous idea of white supremacy would be erased with knowledge.
